This agreement is an official and public offer by the Seller to enter into a contract for the sale of the goods presented on the website https://howar.shop. In accordance with Article 633 of the Civil Code of Ukraine, this agreement is public - its terms and conditions are the same for all buyers regardless of their status (individual, legal entity, individual entrepreneur).

Placing an order on the website means full acceptance of the terms of this agreement, including the rules of registration, payment, delivery, return of goods and liability of the parties.

The Agreement shall be deemed concluded from the moment the Buyer clicks the ‘Checkout’ button on the ‘Cart’ page and receives an electronic confirmation from the Seller.

1. DEFINITION OF TERMS

1.1. Public offer - a public offer of the Seller to an indefinite number of persons to conclude a contract of sale and purchase remotely on the terms of this Offer.

1.2. Product / Service - a product selected by the Buyer on the website, which is the object of sale.

1.3. Online Store - the website https://howar.shop.com, designed for retail and/or wholesale distance selling.

1.4. Buyer - any legally capable person or business entity that orders and/or purchases goods through the website.

2. SUBJECT OF THE AGREEMENT

2.1. The Seller shall transfer the Goods to the Buyer, and the Buyer shall accept and pay for them in accordance with the terms of this Agreement.

2.2. The Agreement shall be concluded from the moment the Buyer fills in the order form on the website and the Seller confirms the order by e-mail.

3. PLACING AN ORDER

3.1 The order is placed by the Buyer independently through the basket of the site.

3.2. The Seller has the right to refuse to process the order in case of doubtful or incomplete information.

3.4. Name, price, quantity of goods are indicated in the basket.

3.5. If necessary, the Seller has the right to request additional information.

3.6. Acceptance of this Offer takes place by filling out the form on the website.

3.7. The Buyer is responsible for the accuracy of the information.

3.8. Acceptance of the Offer confirms that the Buyer agrees to all its terms and conditions and agrees to the processing of personal data in accordance with the current legislation of Ukraine.

4. PRICE AND DELIVERY

4.1 Prices are set by the Seller independently and published on the website in UAH.

4.2 Prices are subject to change, except for already paid orders.

4.3.-4.4. The cost of delivery is not included in the price of the goods. The buyer pays it separately according to the carrier's tariffs.

4.5. Payment is considered made after the funds are credited to the Seller's account.

4.6. Payment options are listed on the website in the section ‘Payment Methods’.

4.7.-4.9. The Buyer is obliged to check the goods upon receipt. Ownership passes from the moment of receipt or transfer of the goods to the carrier.

5. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.3. The buyer is obliged:

6. RETURN OF GOODS

6.1. Return of goods of good quality is possible within 14 days if the presentation, packaging, seals and payment document are preserved.

6.2.-6.4. The cost is returned to the Buyer's account within 30 days. The return shall be made at the expense of the Buyer.

6.5.-6.6. In case of defects in the goods, the provisions of the Law of Ukraine ‘On Protection of Consumer Rights’ apply.

6.7. Goods made according to individual parameters are not subject to return.

6.8. The address for returning the goods is provided by the Seller.

 

7. RESPONSIBILITY

7.1.-7.2. The Seller is not responsible for damage caused by improper use of the goods or inaccurate information.

7.3.-7.4. The liability of the parties is governed by applicable law. Force majeure releases the parties from liability.

8. CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA

8.1.-8.3. The provision of personal data is voluntary and necessary for the performance of the contract. The seller processes data in accordance with the Law of Ukraine ‘On Personal Data Protection’ and the Privacy Policy posted on the website.

9. OTHER TERMS AND CONDITIONS.

9.1.-9.2. The Agreement is concluded on the territory of Ukraine. All disputes shall be resolved through negotiations or in court in accordance with the law.

9.3. The Seller has the right to change the terms of the Agreement by publishing a new version on the website.
